Indonesia's Personal Data Protection Law (PDPL) became effective on October 17, 2022, with a two-year transition period for compliance. This move aimed to clarify the rights of data subjects and the obligations of organisations regarding personal data handling.

The law places several obligations on organisations, such as having a legitimate basis for data processing, obtaining proper consent, following data processing principles, ensuring data security, and adhering to data breach requirements. It also mandates appointing a Data Protection Officer (DPO), conducting Data Protection Impact Assessments for high-risk processing activities, and fulfilling specific requirements for cross-border data transfer.

The PDPL extends various rights to data subjects, including access, modification, consent withdrawal, and legal action against data protection infringements. Exceptions to these rights apply in cases involving national defence, law enforcement, and other specified interests.

The PDPL sets penalties, including fines of up to 2% of the data controller's annual income. Beyond these administrative penalties, the law also prescribes criminal punishments, such as imprisonment for a maximum of six years and monetary fines of up to Rp 6 billion (about USD 385,000) for the gravest violations.
